Starting a bail enforcement action

Under this section, we must have the following provided before starting a new action (these are required):

• An affidavit extending the authority to arrest the defendant;

• The name, last known address, and photograph of the defendant (a copy of the defendant's and cosigner's application and color booking photo);

• The name and principal address of the surety insurance company, its bail agent, or the person posting a property bond or cash deposit that is empowering the bail enforcement agent to arrest the defendant; and

• A valid driver's license or other photographic identifying document or information.

Not required, but essential to a new action: 

• A verified copy of the failure to appear notice or order and warrant;

• Copies the bail contract, indemnity agreements, and applications showing the signatures of the defendant and indemnitor.

Verify the Forfeiture: Before any action, please ensure a judge has issued a bench warrant and that the bail bond has been formally declared forfeited due to the defendant's failure to appear.
